Nuova Webs - Terms of Service
Nuova Webs provides web hosting services to a broad client base and acknowledges its responsibility to safeguard each client's interests and deliver the highest quality services. The subsequent guidelines are established to ensure the fulfillment of this commitment.
Utilization of services offered by Nuova Webs, hereinafter referred to as "Nuova Webs," constitutes acceptance and agreement to these terms and conditions. Throughout this Terms of Service ("TOS"), the terms "us," "we," "our," and "ours" shall denote Nuova Webs. The terms "you," "your," "they," and "them" shall refer to the client or customer of Nuova Webs. All clients, servers, traffic, and equipment under the purview of Nuova Webs are subject to the terms stipulated herein.
Contact & Billing Information:
You are obligated to furnish and maintain accurate, current contact information. This information shall encompass, but not be limited to, email addresses not predicated on the primary domain of your account and active telephone contacts. Accurate and up-to-date contact information is paramount. It remains your responsibility to ensure that the email address on file is current and operational at all times. Nuova Webs assumes no responsibility for any claims, damages, fees, or other liabilities arising from account terminations or suspensions resulting from inaccurate or unusable contact information. The provision of deliberately false contact information may result in the termination of your account. You may update this information through your client dashboard, via email, or by telephone.
Account Setup:
While Nuova Webs maintains the highest standards for near-instant account activations, such immediacy cannot be guaranteed. Certain account types, including dedicated servers, virtual private servers, and colocation services, typically necessitate extended provisioning times. In certain instances, additional fraud verification procedures or information may be required, and you agree to provide requested information in a timely manner. Nuova Webs makes no guarantee regarding the speed of order completion. Accounts will enter the setup queue only upon receipt of payment and successful completion of fraud screening. Account setup will then proceed in the order in which payments are received and orders are screened. In certain circumstances involving dedicated or virtual private server purchases and other high-risk transactions, the submission of government-issued identification and a scanned copy of the credit card employed may be required. Failure to comply with these requirements may result in the cancellation of the order without prior notice.
Account Transfers:
Upon client request, Nuova Webs will endeavor to transfer data from a previous provider to our servers. While Nuova Webs will exert its best efforts, the successful completion of the transfer process is not guaranteed. This complimentary service is rendered on a case-by-case basis, subject to availability and upon request. Variations in software, configurations, and other variables across providers can complicate or impede seamless transfer. Complimentary transfers will be provided, where feasible, when the new environment and control panel mirror those of the previous host or server. You will be notified if a complimentary transfer is not possible, and the associated rate for proceeding, if desired, will be furnished. Nuova Webs does not guarantee the success, completeness, or timely completion of any transfer.
IP Ownership:
In the event that Nuova Webs assigns an Internet Protocol address for your use, the right to utilize such Internet Protocol address shall remain vested solely in Nuova Webs. You shall possess no right to use said Internet Protocol address except as explicitly authorized by Nuova Webs, at its sole discretion, in connection with the provision of services during the term of this Agreement. Nuova Webs shall maintain and control ownership of all Internet Protocol numbers and addresses assigned to you and reserves the right to modify or remove any and all such Internet Protocol numbers and addresses at its sole and absolute discretion. The allocation of IP addresses is subject to the policies of ARIN.
Service Plans:
Shared and semi-dedicated accounts shall not be used for reselling hosting services. Accounts offering unlimited disk space are intended for storing website content. "Website content" is defined as files that are integral to the operation and presentation of your website(s), including but not limited to HTML files, CSS files, JavaScript files, images, videos embedded in your site, PHP scripts, and other script files directly utilized by your website, as well as databases backing your website. You shall utilize this space exclusively for such active hosting files. The space is not to be utilized for the storage of other data, general backup files not generated by our system for your website, archival files unrelated to the website's active content, or the like.
Accounts on "unlimited" disk space plans are subject to an audit when disk space usage reaches 25GB. As long as the data being stored relates directly to the website(s) being hosted (i.e., active website files, databases, and content directly used by the website, as defined above), accounts may continue to utilize disk space beyond 25GB. Nuova Webs strictly forbids storing personal files, personal backups, archives unrelated to the website, or other data not immediately connected with active website operations on web hosting accounts. All "unlimited" disk space is subject to the Fair Use Policy outlined below.
Operating system and file system limitations impose a limit based on the number of files stored on the account, known as "inodes." It is crucial to note that this inode limit is not "unlimited." You are responsible for managing your account inodes. You must actively monitor the amount of stored emails as they add to your inode count. We may impose limits on inodes to ensure system stability and performance. Increasing inodes is possible if deemed fit by the management team, pending compliance with our Fair Use Policy.
Fair Use Enforcement Process:
To ensure responsible and compliant resource utilization, Nuova Webs conducts regular audits of all accounts on our servers. This audit procedure is as follows:
- Audit Trigger: We monitor disk usage, and accounts at or above 25GB trigger a manual audit.
- Backup Suspension (If Applicable): At our discretion, we may disable automatic backups for accounts using 25GB or more. The customer is then notified about the backup suspension, given the chance to review their files, and use less space if they still want the backup service.
- Non-Compliant Data Audit: We assess the account to identify significant disk usage due to non-compliant storage (e.g., data that is not website content, personal files as per the Service Plans section).
- Notification and Grace Period for Non-Compliant Storage: If non-compliant storage is detected, the account owner is promptly notified and given three (3) business days to address the situation by removing the non-compliant data or upgrading their account. During this period, public access to sites remains active.
- Communication and Remediation: As long as a dialogue is initiated by the customer (even without immediate resolution) within that three-day period, further action can often be avoided. We want to work with customers to bring their accounts into compliance.
- Failure to Address (First Stage): If, after the initial three (3) business days, there is no contact from the customer or no action taken to remedy the non-compliant storage, Nuova Webs may then disable public access to any and all sites managed in such context. The customer will be notified of this action.
- Failure to Address (Second Stage): If another three (3) business days pass after public access has been disabled, and there is still no contact or remedy from the customer, the account may be completely suspended.
- Compliance Review: Upon agreement from both parties that the account is in compliance, and after any necessary actions are taken, the account will be reinstated with all previous settings, and public access restored if it was disabled.
- Reservation of Rights: Notwithstanding the above, Nuova Webs reserves the right to take immediate action, including suspension, for severe violations or activities that threaten server stability or other clients, at our sole discretion.
- Alternative Plan Option: Customers needing more flexibility or wishing to store data not defined as "website content" can opt to switch to a hosting plan with guaranteed disk space allocations, which are not subject to this Fair Use Policy for website content. We can discuss plan options.

Updates:
Nuova Webs may update this Fair Use Policy from time to time. We will post any changes on our website. Continued use of our services after any such changes constitutes your acceptance of the revised Fair Use Policy.
Resellers:
Resellers are solely responsible for the support of their own clients. While Nuova Webs is willing to provide assistance, all support requests must be submitted by the reseller on the client's behalf for security considerations. Resellers bear responsibility for all content stored or transmitted under their reseller account, their clients' accounts, and for the actions of their clients. Resellers and their clients are jointly liable for full adherence to all terms stipulated in this agreement.
Nuova Webs reserves the right to reset account passwords if an existing password fails to function or when directed by law enforcement or for the performance of security audits. Clients must ensure that their email addresses, phone numbers, and passwords are current at all times. Nuova Webs reserves the right to audit servers to assure the security and integrity of the network. Dedicated servers are not backed up by default; however, Nuova Webs offers various add-on services available for purchase to assist in the implementation of backup solutions, such as the Enterprise Backup Service or the addition of an extra drive to the server. Nuova Webs Rewards:
The Nuova Webs Rewards program is rendered as an additional, complimentary service. Nuova Webs reserves the right to terminate the program at any time, without compensation or replacement. No guarantees, warranties, promises, or price locks are offered. Program details are subject to alteration or termination at any time, without prior notice. Reward points are applicable solely toward the initial payment for new services. Subsequent payments associated with newly acquired services cannot be satisfied through the utilization of reward points.
Domain Registrations:
Requesting domain name registration via the selection of "new domain" during the order process constitutes a request to register such services on your behalf. While Nuova Webs will register such services on your behalf, ensuring the proper configuration of nameservers for your domain remains your sole responsibility. All domain name registrations are NON-REFUNDABLE. For free domain offers, domains will be transferred only after the money-back guarantee period has elapsed. As the registrant of the new domain, you are required to ensure that accurate Whois information is maintained at all times.
Pricing:
Nuova Webs reserves the right to modify pricing terms on services at its discretion, with notice to affected clients where practicable. While Nuova Webs has limited control over third-party licensing costs, which may increase irrespective of our control, existing clients' web hosting account plan prices will remain unchanged for the duration of their current term. However, add-ons, including but not limited to domains, WHMCS software, control panels, and IP addresses, are licensed from third parties and, as such, are subject to change, including items currently provided at no cost. Such changes will apply upon renewal or new purchase of these add-ons. New accounts for existing customers are subject to the current fees in effect at the time the new account is opened.
Billing and Payments:
You agree to remit payment in advance for services rendered by Nuova Webs. Subsequent payments are due on the anniversary date of your chosen plan term. You acknowledge and agree that services will be deemed active and billable on a recurring basis until such time as formal notification of cancellation for all services is communicated through the proper cancellation form. You acknowledge and agree to all annual and longer-term recurring charges for services not canceled at least thirty (30) days prior to the next renewal date. Maintaining current payment information and ensuring that invoices are paid on time are your explicit responsibilities. Nuova Webs reserves the right to bill your credit card or other payment information on file. Nuova Webs bears no responsibility for fees or charges assessed by your bank as a result of invoice processing. Nuova Webs provides a five-day grace period from the date that invoices are generated. However, any invoices not paid by the due date are subject to a late fee of $7.50 (seven dollars and fifty cents USD) plus ten percent (10%) interest on the past-due amount. Service will be interrupted for accounts that are five (5) days past due. Any service interrupted for nonpayment will remain disconnected until the account balance or contract term is paid in full.
Invoices that are paid more than once or subject to any over-payments will be applied as account credit only and shall not be subject to refund. Any dispute to a credit card charge (chargeback), whether deemed wrongful or intentional, will result in an administrative fee of $50 in addition to the disputed charge prior to service restoration. Nuova Webs may require payment in the form of a cashier's check or money order prior to service restoration. All billing disputes must be reported within thirty (30) days of the date on which the dispute occurred. Nuova Webs retains the option to temporarily deny service or terminate this Agreement upon your failure to remit payment of charges when due. Such termination or denial shall not relieve you of the responsibility for payment of all accrued charges, plus reasonable interest and any collection fees.
Provisioning:
Shared hosting accounts, including Budget, Personal, and Business plans, are typically provisioned within 24 hours of successful signup and payment verification. Provisioning for dedicated servers after payment is guaranteed within 48 hours of order placement. However, if a dedicated server order is placed on a weekend (Saturday or Sunday), the 48-hour timeframe begins the following Monday morning at 5 AM US/Pacific Time.
Cancellation:
All cancellations must be submitted via the cancellation form available on the support center/dashboard. Cancellations are effective on the date that the form is submitted unless otherwise requested. While cancellation fees are not assessed, cancellation must be initiated prior to the commencement of the next billing cycle to avoid charges for the next term. For services with annual or longer-term commitments, cancellation must be submitted at least thirty (30) days prior to the renewal date to avoid recurring charges as outlined in the "Billing and Payments" section. Payments made up to your cancellation date are non-refundable, except in circumstances where cancellation occurs within the thirty (30) day money-back guarantee period, less any applicable non-refundable fees (such as domain registration, setup, or provisioning fees for certain services). Any due or past-due balance on your account must be paid in full prior to the effectuation of cancellation. This does not include any added support or service fees you have contracted Nuova Webs to provide.
Maintenance of an active account requires your timely submission of an official cancellation form. It requires Nuova Webs to provision space, power, and bandwidth for these services, which requires reimbursement by the associated client. Until the proper forms and request are submitted, Nuova Webs cannot know whether to cease providing that accommodation. Unused accounts still utilize system resources, which may be provisioned at the direction of other customers.
In the event that internal collection efforts are unsuccessful, Nuova Webs reserves the right to forward the account to a third-party collection agency or attorney for further action at your expense. Nuova Webs reserves the right to report unpaid balances to credit reporting agencies. Unpaid invoices may negatively impact your credit rating. Nuova Webs prioritizes current clients. Cancellations, which it thus handles with somewhat lower priority, may take up to ten (10) days to process, while effectuation of the cancellation will align with the effective date communicated via the cancellation form you submit. The system shall prevent future billings from that effective date.
Refunds:
Only first-time accounts are eligible for a refund in association with the money-back guarantee. Refunds apply to the money-back guarantee for shared hosting plans. Domain name registrations, dedicated servers, colocation services, service add-ons, software licenses, administrative fees, support fees, and installation fees are all non-refundable. Account renewals and recurring payments subsequent to the money-back guarantee period are also non-refundable. Accounts that fail to cancel prior to the next due date will not be eligible for a refund, and payments made prior to cancellation will not be refunded. You may request an agreed-upon cancellation date that matches the service end date.
Staff and Personal Abuse:
Nuova Webs implores that all clients and staff members treat each other with respect and professionalism. While tolerance and understanding are valued, all staff members are human beings, and a demonstration of human understanding is expected. Abusive or profane language will not be tolerated on Nuova Webs' systems, interfaces, and public and private communications. Abuse of staff in any medium or form will result in either suspension or termination of service.
Content:
You are responsible for all content within your site or account at all times. All services provided by us may be used for lawful purposes only. The transmission, storage, or presentation of any information, data, or material in violation of any United States Federal, State, or City law is prohibited. The infringement of any copyright or trademark through the use of our services is prohibited.
Nuova Webs permits the storage and serving of legal adult content on dedicated servers, colocation services, and VPS accounts. "Adult content" is defined as materials, including but not limited to images, videos, and text, that are of a sexually explicit nature, intended for adult audiences, and which are legal under United States Federal, State, and City law. This does not include content that is violent without context (e.g., gratuitous violence), or that exploits, abuses, or endangers children. All other services not explicitly listed herein (e.g., shared hosting) are forbidden from storing, serving, or containing any adult materials. Nuova Webs reserves the right to determine the definitive interpretation of "adult content" as it pertains to our services in borderline cases, always erring on the side of caution and legality.
You agree not to transmit, store, or present any content on our servers that:
- Violates any United States federal or state law regarding child pornography. Nuova Webs will immediately report content that constitutes child pornography as defined by 18 U.S. Code § 2256: "any visual depiction, including any photograph, film, video, picture, or computer or computer-generated image or picture" etc. of a minor engaged in sexually explicit conduct. Nuova Webs maintains a zero-tolerance policy for such content.
- Is offensive in nature. "Offensive content" is defined as content that promotes bigotry, discrimination, hatred, or violence against individuals or groups based on race, ethnic origin, religion, disability, gender, age, veteran status, sexual orientation, or gender identity. Offensive content also covers any form of unlawful or indecent sexually explicit material as defined by applicable U.S. law that falls outside the acceptable definition of "Adult Content" where permitted.
- Links to materials containing content violating these terms are also prohibited.
Threats and Unlawful Conduct:
Our service shall not be used to transmit any material (via e-mail, uploading, or posting) that threatens or encourages physical harm or destruction of property. The transmission of any material (via e-mail, uploading, or posting) that harasses another company or individual will lead to the account's immediate and permanent termination.
Fraud:
Our service shall not be used to make fraudulent offers to sell or buy products, items, or services, or to advance any financial scam such as "pyramid schemes," "Ponzi schemes," and "chain letters." Adding, removing, or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous re-mailers or nicknames does not constitute impersonation. Impersonation involves a knowing misrepresentation, or a misleading statement, writing, or activity made with the intent that the person receiving it will act upon it.
Attacks and Exploits:
You must not interfere with or disrupt other network users, services, or equipment, or use any services in order to negatively affect other people or entities. This includes denial-of-service (DOS) attacks against another network host or individual user. It is the client's responsibility to ensure that their server is configured securely. A client may not, either by action or inaction, allow others to use their network for inappropriate or unauthorized actions. Unauthorized entry into and/or use of another company or individual's computer system will result in immediate account termination. We will not tolerate any subscriber attempting to access other accounts, or penetrate security measures of other systems.
Commercial Advertising Email (SPAM):
Nuova Webs maintains a zero-tolerance spam policy and strictly enforces its tenets. The transmission of unsolicited email from our servers or the use of an email address that is maintained by Nuova Webs is strictly prohibited and will automatically result in the immediate deactivation of your site without refund. This includes, but is not limited to, sending bulk emails that are not compliant with the CAN-SPAM Act.
Sites advertised via SPAM (Spamvertised) are not permitted on our network. This includes, but is not limited to, SPAM sent via fax, email, instant messaging, or usenet/newsgroups. Any account which results in our IP space being blacklisted will be immediately terminated.
Nuova Webs will serve as the sole arbitrator in determining violations of this provision. Claims investigated by Nuova Webs regarding spam originating from users or their subscribers will be billed for the investigation. The clean-up fee will be determined at the discretion of Nuova Webs and will not be less than $500 per incident.
Programs/Daemons:
Programs are prohibited from running continually in the background of shared hosting servers, except for legal daemons running on a VPS or dedicated server, of which IRC and Proxy services (unless explicitly part of an agreed service plan) do not qualify. This policy reduces system resource use and the operational maintenance needed. IRC or IRC bots are prohibited on our network. Proxy services not explicitly approved are prohibited on our network.
Server Abuse:
Endeavors aimed at undermining or causing harm to any Company server or customer of Nuova Webs are strictly prohibited. We hold no responsibility for clients' account use. In cases of resource abuse, such as scripts consuming excessive CPU cycles or other resources to the detriment of server stability or other clients, Nuova Webs will first attempt to mitigate the issue, potentially by disabling the specific offending script or process, and will notify the customer with details of the issue and required actions. If the issue is severe, causes major disruptions, or is not addressed by the client in a timely manner after notification, Nuova Webs reserves the right to suspend the affected service or account. Repeated or intentional abuse will lead to deactivation without any refund of previous payments. Sites using excessive CPU cycles or other resources, creating strain on other sites, may be subject to new terms or required to upgrade. Accessing or attempting to access another's account, or an attempt to penetrate security measures of the Company's (or an entity's) hardware, electronic communications system, or telecommunications system, is strictly prohibited and will result in immediate termination.
Security:
You are responsible for any misuse of your account, regardless of whether the inappropriate activity was committed by a friend, family member, guest, or employee. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account. Additionally, you may not breach the security of another account, or try to gain unauthorized access to another network or server. It is prohibited to share your password and account access with unauthorized users, for such use renders you responsible. Obtaining, or attempting to obtain, another user's account password is strictly prohibited, and may result in termination of service. It is prohibited to attempt to circumvent the user authentication or security of any host, network, or account. Violation of systems or network security may incur criminal or civil liability. Nuova Webs shall cooperate fully with investigations of violations of systems or network security at other sites, including cooperation with law enforcement entities involved in the investigation of suspected criminal violations.
Resource Usage:
If our system administrators determine the unacceptable use of a customer's account (as outlined under Server Abuse and other relevant sections), Nuova Webs may temporarily deactivate the account or specific services in question to preserve server integrity for other users, typically after notification as described in the Server Abuse section. We may contact the client to offer alternative solutions for their accounts to keep their account active without degrading other clients’ services. The Company is the sole arbiter in determining violations of this provision. Clients must not use more than 30% of a system's resource for more than one minute, or 150,000 inodes per single account on shared/reseller plans unless otherwise specified in their plan. Each file on a server represents one inode. Clients reaching or exceeding this limit will be contacted so we may evaluate their needs and arrange alternatives, if necessary.
Storage of files not directly related to the active operation of your website(s), such as personal backups, non-website related media archives (e.g., extensive personal MP3 or DVD collections), upon a shared or semi-dedicated account is prohibited. Large, plentiful files used in this manner on an active system can create file system corruption and lead to data loss, and are outside the scope of "website content" for unlimited plans.
Accounts must not send more than 200 emails per hour from such shared, semi-dedicated, or reseller account unless a higher limit is specified in their plan. Any emails above that limit will be discarded. Emails can be batched to stay within limits. VPS and Dedicated servers are exempt from this specific hourly limit but are subject to general anti-spam and network abuse policies.
Bandwidth Usage:
Your account is provided with a monthly bandwidth allocation, which varies at the chosen service tier, or is unmetered subject to fair use on certain plans. If your account exceeds the allotted amount on metered plans, or its usage on unmetered plans is deemed detrimental to the network, we reserve the right to suspend the account until the start of the subsequent month, require an upgrade to a higher plan, or offer the purchase of additional bandwidth. We are generally lenient on bandwidth and provide appropriate time to find a solution that will work for your needs. Less than 0.001% of clients typically express high enough bandwidth needs to work on custom plans. Termination of the account renders the responsible party liable for any usage or associated fees for overages. Dedicated server data transfer usage is calculated using 95th percentile, also known as burstable billing, in order to assist clients from heavy overage penalties should they experience unanticipated spikes in traffic.
Back-ups and Data Loss:
All clients use our services at their own risk. Nuova Webs performs courtesy daily or near-daily backups for many accounts on shared and reseller servers; however, these backups are provided with no warranty or guarantee of availability or viability. While we make a best effort to ensure these backups are viable, the only way to fully confirm viability is through an attempted restoration. If a backup is found to be non-viable, we can only work to correct the issue for future backups. You are strongly advised to maintain your own regular backups of all your files to your local drive or use an additional dedicated backup service.
At our sole discretion, Nuova Webs may attempt to restore files, directories, or databases from our available backups upon your request, typically at no charge. However, we make no guarantees regarding the availability of specific dates or the success of any restoration. If we deem user-requested backup restorations to be excessive in frequency or scope, we reserve the right to charge a fee for this service, which will be communicated to you beforehand. Many control panels offer tools for users to create and restore their own backups; clients are encouraged to utilize these tools first.
Any site using more than 25GB of disk space may, at our discretion, be excluded from our complimentary automated backup service. Clients with larger sites or critical data are encouraged to purchase dedicated backup services. Nuova Webs is not responsible for lost data, time, or income due to errors when implementing backups, non-existent backups, or failed restoration attempts. Restoration is not always a fast process; due to the volume of data, compression, and network transfers, it can sometimes take several hours or even days. We encourage purchasing separate managed backups from one of our backup plans for clients who believe their data is of critical importance to their business or livelihood.
Money-Back Guarantee:
Any first-time shared hosting client is eligible for a 30-day money-back guarantee, beginning the day the account login details are sent out. Requests to cancel the account and receive a full refund within 30 days of signing up must include a cancellation form submitted in the support center prior to the 30th day of service. The guarantee is for the hosting plan fee only, exclusive of extra services or setup fees such as add-ons, domain name registrations, SSL certificates, dedicated IP addresses, software licenses, programming work, administrative fees, or web design services.
Colocation and Dedicated servers are not entitled to this guarantee due to the time and expenses incurred on each order.
Network and Hardware Guarantees:
Refer to Service Level Agreement (SLA), which will be provided separately or made available on our website.
Refusal of Service:
Nuova Webs reserves the right to refuse, cancel, or suspend service at our sole discretion, though we aim to do so for reasons outlined within these Terms of Service or due to violations of applicable law or policy.
Indemnification:
Nuova Webs clients agree to defend, indemnify, and hold us harmless from demands, liabilities, losses, injury, costs, and claims, including reasonable attorney's fees, asserted against Nuova Webs, our agents, customers, officers, and employees, that may arise or result from any service provided or performed or agreed to be performed, or any product sold by customer, its agents, employees or assigns. Clients further agree to defend, indemnify, and hold harmless Nuova Webs against liabilities arising out of any injury to person or property caused by any products sold or otherwise distributed in connection with Nuova Webs' server; any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; copyright infringement; and any defective products sold to customer from Nuova Webs' server. This indemnification extends to any claims resulting from your use of the service which damages you or any other party.
Governing Law:
In using Nuova Webs services, you agree to submit to binding arbitration for any disputes or claims arising out of or relating to this Agreement or the services provided. The arbitration shall be administered by the American Arbitration Association (AAA) in accordanceance with its Commercial Arbitration Rules (or other appropriate AAA rules). The arbitrator shall be selected through the procedures of the AAA. The Federal Arbitration Act, not state arbitration law, governs arbitration under this Arbitration Clause. Each party agrees that actions in connection with this Agreement must be handled by the arbitrator chosen through the AAA. The arbitrator's award is final and binding on all parties. Arbitration and related costs will be handled in accordance with the rules of the AAA, which may include provisions for the allocation of costs. This Agreement is deemed to be the culmination of direct negotiation and requires immediate documentation of consent.
Disclosure:
Nuova Webs will cooperate with law enforcement agents. We will only disclose subscriber information, including assigned IP numbers, account history, and account use, to a law enforcement agent or official who provides an authentic subpoena or lawful request in accordance with applicable law.

Nuova Webs is not liable for any claims resulting from the use of our service; we are not responsible for any damages your business may suffer. We issue no statements of express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose. This excludes loss of data from delays, non-deliveries, wrong delivery, and service interruptions regardless of cause. The client acknowledges that the service provided can be interrupted for many factors beyond our direct control, as well as for maintenance. Therefore, clients agree that Nuova Webs shall not be accountable for any damages, loss, or injury arising from service availability or data integrity issues.
Modifications:
Nuova Webs reserves the right to revise, amend, or modify these tenets and our other policies at our discretion. Notice of significant material changes will be provided to clients via email or through a prominent notice on our website, allowing clients a reasonable period (e.g., 30 days) to review such changes. Continued use of the services after such notice period will constitute acceptance of the revised terms. If a client does not agree to the material changes, their sole remedy will be to terminate their services with Nuova Webs in accordance with the cancellation policy. Failing to follow terms or conditions may trigger account actions as outlined elsewhere in this TOS. All users are responsible for recognizing and complying with the newest versions of our terms. A change in these terms by Nuova Webs shall not be the basis for non-payment, but material changes may provide a basis for contract termination as described herein.
